North Carolina is a “OSHA approved state-plan" state - that is, its state plan is an OSHA-approved workplace safety and health program operated by the state of North Carolina. The state plan covers both private sector and government workers, is monitored by OSHA, and must be at least as effective as OSHA in protecting workers and in preventing work-related injuries, illnesses and deaths. As per the state plan, every employer across North Carolina must have a written occupational health and safety program in place covering the 7 core OSHA elements. North Carolina Gen. Stat. § 95, Article 22 also requires safety plans for employers with an EMR of 1.5 or above develop a written safety program.
