HSE International Group Limited, on behalf of itself and its Affiliates, (“HSEI Group,” “we,” “us,” or “our”) is committed to privacy and data protection. This Privacy Policy and Notice at Collection (“Notice”) applies to information that HSEI Group collects on the HSEI Group website, www.hseigroup.com, through the HSEI Group software applications, products, and services, and any other website or services authorized by HSEI Group that links to this Notice (collectively, the Services), as well as how we use and protect personal information. Your privacy is important to us. Please read this Notice to learn about the information that HSEI Group collects from you and how HSEI Group uses that information.

This Notice describes the information that we collect (directly or indirectly) and why we collect it, what we do with the information we collect and how you can manage personal information about you (defined below). Where you provide personal information through our platform solutions, such as the ICAM Plus platform, HSEI Group shall process this information as a data processor on your behalf or on behalf of your employer or business (our “Customer”). Where HSEI Group uses such personal information for marketing or business purposes (e.g., metrics), HSEI Group shall be considered the data controller. Additionally, HSEI Group is the controller of the personal information we collect through the hseigroup.com website. Information We Collect

We collect information that identifies, describes, or is reasonably capable of being associated with you (“personal information“). The following discusses the categories of personal information we collect and have collected in the preceding 12 months, the sources from which we collect information, and the business or commercial purposes use of personal information about you. When you visit and use our Services we may collect the following categories of personal information:

Identifiers - Such as a real name, alias, postal address, telephone number, unique personal identifier, online identifier, Internet Protocol address, email address, account name, or other similar identifiers.
Financial Information - Such as your payment card number, credit score, billing address, and related financial information.
Your Opinions or Other Information - For example, if you review the products you have purchased from us or provide information about products, and the brands you use.
Commercial Information -Records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
Online Communications -Information derived from your business-related requests, communications, emails, chat conversations, and dealings we have with you, or the organization you work for or are associated with.
Geolocation Data -Such as physical location. We do not collect precise geolocation data from you or your device, but may collect and use information about your general location (such as any state or country of residence supplied by you when setting up your user profile) or infer your approximate location based on your IP address in order to track our general website usage or to tailor any pertinent aspects of your user or educational experience to your region.
Internet or Other Similar Network Activity -Such as browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement. As described in more detail in our Cookie Policy, if you use our Services, we automatically collect information about your browsing and search history, interaction with the features of our Services, and responses to advertisements. This includes behavioral data such as mouse movements, cursor position, hover interactions, click patterns, scroll depth, keystroke dynamics, form field interactions, and session duration.
Inferences Drawn From Other Personal Information -Such as a profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
Professional or Employment-Related Information - Such as current or past job history or performance evaluations.
Protected Classification Characteristics - Such as age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information). Some of this information may be considered Sensitive personal information.

Sources of Personal Information

We collect personal information from the following sources:

Directly from you when you provide it through forms, account creation, purchases, or communications
Automatically through tracking technologies when you visit our Services
Third-party data providers and enrichment services including Dun & Bradstreet (“D&B”), ZoomInfo, 6Sense Insights Inc., G2, Marketo, and LiveRamp, which provide business intelligence and data enrichment based on your IP address, company information, and professional profile
Marketing and advertising partners that provide demographic and interest data
Social media platforms when you interact with our content or link your accounts
Business partners and affiliates that share information in connection with joint services

We may use these categories of personal information for the following purposes:

Products and Services You Requested

To administer our relationship with you and to carry out our obligations arising from the relationship between you and us, including internal accounting and administration purposes, to process payment for purchases or other services and to create and manage your account. Customers may use our tools to schedule, manage and track workplace incidents and formal safety meetings and to ensure compliance with state and federal safety regulations and this may provide HSEI Group with human resource-related data such as date of birth, age, gender, job title and work history. Also, customers using our tracking and streamline tools to submit regulatory reports may provide HSEI Group with more sensitive information such as incident records, etc.

The HSEI Group may also collect, from you, the following personal information about your contacts: (a) name and email address, in order to refer our products or services, share an article, blog post or other content or (b) through our “import contacts” feature we may collect the name, email address, phone number of your contacts in order to provide description of use/purpose of collection e.g. to connect you with people you know who also use our Service. When you provide us with personal information about your contacts, we will only use this information for the specific reason for which it is provided.

To provide you with products and services we may collect: Identifiers, your opinions or other information, Protected classification characteristics, Commercial information, Online Communication, Geolocation data, Inferences drawn from other personal information, and Internet or other similar network activity

Mobile Applications

When you download and use our mobile applications, we automatically collect information on the type of Device you use and the operating system version. HSEI Group sends you push notifications from time to time to update you about any events or promotions that we may be running. If you no longer wish to receive these types of communications, you may turn them off at the device level. To ensure you receive proper notifications, we will need to collect certain information about your Device such as operating system and user identification information. We do not ask for, access or track any location-based information from your mobile Device at any time while downloading or using our mobile application.

HSEI Group uses mobile analytics software to allow us to better understand the functionality of our mobile software on your phone. This software may record information such as how often you use the application, the events that occur within the application, aggregated usage, performance data, and where the application was downloaded. We do not link the information we store within the analytics software to any personally identifiable information you submit within the mobile application. To provide you with mobile applications we may collect: Identifiers, and Internet or other similar network activity.

Processing Payments

After you place an order on our website, or via one of our mobile applications, you will need to make payment for the goods or services you have ordered. Your payment may be processed either via the devices app store or by one of our third party payment processors (the “Payment Processors“). The Payment Processors collect, use and process information about you, including payment information, in accordance with their privacy policies. Information you provide to the Payment Processors may be used for payment transaction processing and fraud prevention. To process payments, we may collect and process: Identifiers, Financial information, and Commercial information.

Artificial Intelligence

We may use artificial intelligence technology to process personal information in connection with the performance of our services, communications, and/or through the chat feature on our website. We may use anonymized and aggregated data to train, retrain, tune, validate, modify, update or otherwise improve any such artificial intelligence technology. In connection with artificial intelligence, we may collect and process: Identifiers, Commercial Information, Online Communications, Internet or other similar network activity, and Geolocation data.

Searching Our Website

We collect and process personal information to enable you to use the website search functionality and to return relevant results based on your queries. This may include identifiers such as IP address, device information, and search terms entered on our site. We use this information to improve search accuracy, maintain system performance, and monitor usage trends. When you use the search feature, we may share the data your enter with third-party service providers that support our website functionality, analytics, and performance monitoring. In connection with artificial intelligence, we may collect and process: Identifiers; Internet or other network activity (e.g., search queries, interaction logs); and Geolocation data.

Tailored Advertising

In order to deliver relevant website content and advertisements to you and measure or understand the effectiveness of the advertising we serve to you, we, or with third-party vendors, may use your personal information to provide you with tailored advertising on third-party websites, including social networking sites and other websites or services with user-generated content features. These advertisements are either: (i) “contextual” (meaning they are presented due to the webpage that you are viewing); or (ii) “behavioral advertising” or “interest-based advertising” (i.e., where advertisements are shown to you based upon your interests which we have inferred from your information including demographic, geographic, and interest-based data). We may use tailored advertising to specifically include or exclude individuals who have registered for our products to ensure that you are provided with information about those products that are most relevant to you. To do this, we may track your browsing activity across different websites, different Devices and/or different applications. We may match your browsing activity on one Device, such as your mobile phone, with your browsing activity on another Device, such as your tablet, to ensure our advertising is tailored to you.

If you no longer wish to see tailored advertising, you can manage your cookie preferences and choose to opt out of those cookies by managing this through your device. In addition, some third-party sites allow you to stop seeing advertisements from specific advertisers on that site, so you should also check your preferences on those websites. Cross-Context Behavioral Advertising and Cross-Domain Tracking

We track your activity across multiple HSEI Group websites and subdomains, including hseigroup.com and related properties operated through different content management systems. We use cookie synchronization, consistent identifiers, and unique URL parameters to connect your activity across these properties and across different devices. This cross-domain tracking allows us to build a profile of your interests and deliver coordinated advertising experiences. In some jurisdictions you have the right to opt out of this cross-context behavioral advertising. To provide tailored advertising we may collect and process: Identifiers, Customer records, Protected classification characteristics, Commercial information, Internet or other similar network activity, Geolocation data.

Analytics

For example, we may analyze personal information about you including your location, products and/or services requested, time zone, IP address and URL visited, against our wider customer base for internal business purposes, such as generating statistics and developing marketing plans, to improve our services and products and the website. We may also aggregate and de-identify information about you to create customer segments and share with our affiliates and partners. For analytics purposes we may collect: Internet and network information.

Business Intelligence

We engage in profiling by combining your behavioral data (including pages visited, content viewed, time spent, and interaction patterns), IP address, device information, and other identifiers to create a profile of your company, professional role, industry, and business interests. We share your IP address and behavioral signals with business intelligence platforms (such as Dun & Bradstreet) to identify your company, match your activity to existing business contacts in our database, and enrich our understanding of your professional profile and purchasing intent. This profiling is used to:

Determine what advertising and content to show you; Identify high-value business prospects; Prioritize sales and marketing outreach; Personalize your website experience; and Share audience segments with advertising platforms for targeted advertising.
Form submissions may be sent to D&B in real-time as you populate form fields to enrich the data with additional company and contact information. You have the right to object to profiling under applicable privacy laws including GDPR Article 21 and similar US state privacy law provisions.
For profiling and business intelligence we may collect and process: Identifiers, Professional or employment-related information, Internet or other similar network activity, Geolocation data, Commercial information, Inferences drawn from other personal information.

Non-Marketing Communications

We may use personal information about you to communicate with you about important information in relation to your account, the service you have requested or other non-marketing communications. This includes: (i) to process and respond to your questions and/or inquiries; (ii) emailing you to verify your identity when you sign-up; (iii) emailing you where you have requested a password and/or username reset; (iv) notifying you that a particular service has been suspended for maintenance or terminated; (v) letting you know that we have updated this Notice or our Terms of Use; or (vi) letting you know about any products that you have requested or purchased. We will never contact you to ask for your password - please be careful if you receive any communications from people requesting this information. For example we may use personal information about you provided to us to:

Information Collected Automatically

When you interact with HSEI Group, we may use cookies to automatically gather certain information about you. These include:

Internet or Other Electronic Network Activity Information: This includes your browsing history, search history, and interactions with our website, applications, or advertisements. For example, when you visit our services or engage with HSEI Group content, we may collect data from your device, such as your IP address, device type (make and model), unique device identifiers, browser type, and time zone settings. We also track how your device interacts with us, including pages accessed, links clicked, navigation patterns, preferences, products or services viewed or searched for, and any crashes or download errors.

Linking Information

If linked information directly or indirectly identifies an individual person, we treat the linked information as personal information. In this Notice, to “process” personal information means to perform any operation on personal information, whether by automated means, such as collection, recording, organizing, storing, adapting, use, disclosure, combining, erasing or destroying. Where we need to collect personal information by law, or under the terms of the contract between us and you do not provide that data when requested, we may not be able to fulfil the contract we have or are trying to enter into with you. In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case.

Change of Purpose

We will only use personal information about you for the purposes for which it was collected, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us. If we need to use personal information about you for an unrelated purpose, we will notify you and we will explain the business purpose which allows us to do so. Certain personal data, such as information about medical or health conditions, racial or ethnic origin, political opinions, religious or philosophical beliefs, is considered “Sensitive Information” and not expected to be processed in connection with this Policy. To the extent that Sensitive Information may be processed, HSEI Group will not use Sensitive Information for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual unless HSEI Group has received your affirmative and explicit consent (opt-in). Please note that we may process personal information about you without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

Retaining Data

We retain personal information in identifiable form only for as long as necessary to fulfill the purposes for which the personal information was provided to HSEI Group or, if longer, to comply with legal obligations, to resolve disputes, to enforce agreements and similar essential purposes. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information, the purposes for which we process personal information and whether we can achieve those purposes through other means, and the applicable legal requirements. We retain consent records for a minimum of five (5) years from the date consent is provided or withdrawn to enable us to demonstrate compliance with applicable privacy laws.

Data Collected for Business Purposes

In connection with your general use of our Services:

With Service Providers, Contractors, and Agents. We may share personal information with third parties who perform services on our behalf, such as payment processing, data analysis, email and hosting services, customer service and support, fulfillment companies, application development and web hosting companies’ information technology and related infrastructure providers, email providers, or audit and professional services providers. These service providers may access personal information about you and are required to use it solely to provide our requested service.
Social Media Platforms. If you link or sign in with your social media accounts through our Services, we may share personal information with those third-party social media sites.
With Our Marketing Partners. In addition to the above, information collected in never shared with third parties for promotional or marketing purposes. Mobile opt-in and consent are never shared with anyone for any purpose. Any information sharing that may be mentioned elsewhere in this policy excludes mobile opt-in data.

HSEI Group web pages may use other technologies such as web beacons to help deliver cookies on the Services and count users who have visited those websites. In addition to standard cookies and web beacons, the Services can also use other similar technologies to store and read data files on your computer. Your Rights and Choices

Right to Access Specific Information and Data Portability Right - You have the right to request that we disclose certain information to you about our collection and use of personal information over the past twelve (12) months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

The categories of personal information we collected about you.
The categories of sources for the personal information we collected about you.
Our business or commercial purpose for collecting or selling that personal information.
The categories of third parties with whom we share that personal information.
The specific pieces of personal information we collected about you (also called a data portability request).

Right to Correct Information

You have the right to request we update personal information about you that is incorrect in our systems.

Right to Delete

You have the right to request that we delete any personal information about you that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) the personal information from our records, unless an exception applies.

How to Exercise these Rights

To submit a request to exercise these rights email us at privacy@hseigroup.com.

For all requests, please clearly state that the request is related to “Your Privacy Rights,” indicate which type of request you are making, and provide your name, street address, city, state, zip code and an e-mail address or phone number where we may contact you. We are not responsible for notices that are not labeled or sent properly or that do not include complete information. To appeal against a decision regarding a consumer rights request, please submit your appeal using one of the three methods above. Your appeal should include an explanation of the reason you disagree with our decision. Within 60 days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. Only you, or a person that you authorize to act on your behalf, may make a verifiable consumer request related to personal information about you. You may also make a verifiable consumer request on behalf of your minor child.

You may only make such a request for access or data portability twice within a 12-month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative and describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response electronically. All the disclosures we provide will only cover the 12-month period preceding the receipt of the verifiable consumer request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide the personal information that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Opt-out Preference Signals

Our website honors General Privacy Control (“GPC“) opt-out preference signals when such signals are configured through your browser.

We commit to maintain and use de-identified information only in de-identified form; not to attempt to re-identify it (except solely to test, analyze, or validate our de-identification methods or as required by law); to implement reasonable safeguards to prevent re-identification; and to require any recipients of de-identified information to do the same. “De-identified” means information that cannot reasonably be used to infer information about, or otherwise be linked to, a particular consumer or household.

International Transfers of Personal Information

Data Privacy Frameworks

HSEI Group, including its affiliates, complies with the EU-Canada Data Privacy Framework (“EU-Canada DPF”), EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) and to the rights of EU and UK individuals and Swiss individuals as set forth by the U.S. Department of Commerce.

HSEI Group has certified to the Canadian Chamber of Commerce that it adheres to the EU-Canada Data Privacy Framework Principles (“EU-Canada DPF Principles”) with regard to the processing of personal data received from the European Union in reliance on the EU-Canada DPF and from the United Kingdom (and Gibraltar) under the UK Extension to the EU-Canada DPF. HSEI Group has certified to the Canadian Chamber of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (“Swiss-U.S. DPF Principles”) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-Canada DPF, EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.

HSEI Group is responsible for the processing of personal data it receives, under the DPF, and subsequently transfers to a third party acting as an agent on its behalf. HSEI Group complies with the DPF Principles for all onward transfers of personal data from the EU, UK, and Switzerland, including the onward transfer liability provisions. The Canadian Chamber of Commerce has jurisdiction over HSEI Group’s compliance with the EU-Canada DPF, EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. In certain situations, HSEI Group may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

In compliance with the EU-Canada DPF, EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, HSEI Group commits to cooperate and comply respectively with the advice of the panel established by the EU data protection authorities (“DPAs”) and the UK Information Commissioner’s Office (“ICO”) and the Swiss Federal Data Protection and Information Commissioner (“FDPIC”) with regard to unresolved complaints concerning our handling of human resources data received in reliance on the EU-Canada DPF, EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF in the context of the employment relationship. HSEI Group commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-Canada DPF, EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF to TRUSTe, an alternative dispute resolution provider based in Canada. These dispute resolution services are provided at no cost to you.

For complaints regarding EU-Canada DPF, EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF compliance not resolved by any of the other DPF mechanisms, you have the possibility, under certain conditions, to invoke binding arbitration. Age of Consent

The Services are not directed to or intended for use by individuals under the legal age of majority in the individual’s country of residence (“minors“).
