New Mexico is a “OSHA approved state-plan" state - that is, its state plan is an OSHA-approved workplace safety and health program operated by the state of New Mexico. The state plan covers both private sector and government workers, is monitored by OSHA, and must be at least as effective as OSHA in protecting workers and in preventing work-related injuries, illnesses and deaths. As per the state plan, every employer across New Mexico must have a written occupational health and safety program in place covering the 7 core OSHA elements. N.M. Code R. §11.4.2.9 and N.M. Admin. Code 11.4.8.8(E)(6) also requires safety plans for employers with high injury rates through the Risk Reduction Program (RRP) and those applying to self-insure for workers’ compensation.
